Patient: Smith, Jane DOB: 06/ 13/ 1985 Date of Interview: 02/05/2010 Date of Report: 02/06/2010 IDENTIFYING INFORMATION: Ms. Smith is a 24 year old white woman currently residing in Vancouver, WA. She is employed as a hairstylist and currently lives in an apartment with two friends and their newborn son. Ms. Smith has been seen for mental health symptoms previously as a teenager, and was referred again on this visit by a colleague. The following report information is based on information collected from my interview with the patient, her medical chart, and psychological testing. CHIEF COMPLAINT: â€Å"I feel like sometimes my life is too much to handle. It makes me sick to think about things and I am not sure I can stand much more. I feel like there is no hope. I am all alone and I think I will always be alone. † HISTORY OF PRESENT ILLNESS: Ms. Smith says she frequently suffers from anxiety attacks and is often times unable to cope with stress while at work. She states she feels sweaty, weak and dizzy when thinking about life. Over the last two years she has been unable to relax, often has difficulty falling or staying asleep, and often feels ill and tired. She says her primary way of coping is alcohol. When unable to drink she reports her anxiety levels being â€Å"unbearable† and tries to stay away from social interaction. She also reports that her anxiety increases after nights of drinking as she feels like everyone is watching her. Ms. Smith has been diagnosed with high blood pressure which may be caused by her weight gain over the last three years. SOCIAL HISTORY: Ms. Smith is currently single and has no children. She was living with her father until she was forced to leave after a domestic dispute caused a no contact order between them two years ago. Her mother and father separated four years ago and her mother moved out of their house into her own apartment. She states that until the separation she heavily relied on both parents for social and financial support. She has two older sisters, both of whom do not live in the area. While she says that one sister is caring she describes the other as â€Å"self-centered† and says she has a hard time staying close to either due to location. She recalls her childhood as â€Å"normal† although she felt like her parent’s attention was given primarily to her sisters. She says that she has a large group of friends, but tries to hide her emotional distress and anxiety from them as she does not want to be burdensome. Ms. Smith reports suffering from significant financial distress after moving out of her parents. She also says she is unhappy with her living situation and the new addition to their household. Ms. Smith also shows great concern over being single and without a relationship since she was 16. She attributes her problems in dating to her gain in weight and says it has dramatically decreased her self esteem. CURRENT/PAST PYCHIATRIC HISTORY: Ms. Smith reports that at age 16 she visited a mental health clinic for the same symptoms and was diagnosed with general anxiety disorder and depression. She was prescribed an antidepressant and also attended counseling sessions one to two times weekly. Ms. Smith said that her symptoms improved within six months and she discontinued both the use of her prescription and counseling. She said after discontinuation symptoms once again started to reappear, however with less intensity, until the past few years when intensity has increased. CURRENT AGGRESSIVE IDEATION AND BEHAVIORNO X YES ALCOHOL AND SUBSTANCE USE HISTORYNO YES X Patient reports that she consumes alcohol on average five times a week. She drinks five to ten drinks per sitting. She also reports that on occasion the smokes marijuana. While Ms. Smith states that she does not think alcohol or drugs are negatively affecting her, she does report increased anxiety and paranoia after drinking. She has also been ticketed and charged for having a controlled substance after her car was searched for a routine traffic violation. DSM- IV DIAGNOSTIC IMPRESSIONS AXIS I: Generalized Anxiety Disorder Dysthymic Disorder AXIS II: Deferred AXIS III: High Blood Pressure AXIS IV: Adjustment to weight gain and changes in finances, social support, and lifestyle AXIS X: Global Assessment of Functioning Scale Score: 80 CLINICAL FORULATION: Ms. Smith presents as very depressed and anxious. Her symptoms appear to be that of dysthymic disorder and generalized anxiety disorder. I believe that these are onset by interlinked biological, psychological and social factors. It is likely that the dysthymic disorder results from maladaptive, flawed, or irrational cognitions taking the form of distorted thoughts and judgments. Ms. Smith has experienced traumatic family situations, unwanted separation, as well as lack of social support from family and friends. It appears that these have caused her to feel negatively about herself which has affected her feeling of self-worth and ability to successfully respond to the tasks and stressors present in daily living. It is likely that these maladaptive behaviors were learned from friends or family. These stressors are causing increased anxiety and hopelessness. The anxiety disorder developed a result of not being able to cope with the dysthymic disorder. Due to the fact that these are so closely intertwined, without treatment the depression and anxiety Ms. Smith is experiencing, as well as alcohol dependency will likely worsen. TREATMENT PLAN: Outpatient therapy may involve medication and/or therapy. Behavior therapy will help Ms. Smith to examine her behaviors as to determine exactly what is decreasing her mood or keeping her from achieving goals. This therapy should be conducted in individual therapy sessions, one or more times a week until symptoms improve. As well as therapy Ms. Smith should be prescribed an antidepressant to deal with the contributing biological factors. Ms. Smith should seek evaluation for alcohol and drug dependency, as it appears she is using these substances for self medication. It is important that she discontinues use in order to learn new coping mechanisms.

The film that I saw last week is about the dangerous art of extraction valuable secrets from deep within the subconscious during sleep, when the mind is most vulnerable. The main character of the film called Cobb. He is a talented thief, the best of the best in his work. At the beginning of the film we see Cobb’s dream in which he with his wife lived in their town that they create alone in unexpected for me and I was surprising when I saw how in our dream we can see people who not existent in the reality. Then the point is that Cobb’s command received the proposition to change some events in the life of one of the richest company in the world. They had to do that this company fell down and other man who managing other company could be the first and control others. If Cobb, and his command do this he promise Cobb to help him with law, because as we know he was a thief and all police search him and that’s why he can’t returned home to his children. For this work he must to find a new architecture, because without him it will be not possible. Architect – a specialist defining illusory world for another dream. The purpose of the architect when extracting – designed sleep so sleep could not distinguish it from reality and create a sleeping most complex maze of sleep, from which the victim could not easily escape. The complexity of this work was that this dream consisted of three levels, that is to say they must to reach the deepest within of the subconscious to change what they want. Now their task – not to steal an idea, but to implement it. If they succeed, it will be the perfect crime. I realized they done this work in the best way. To my mind this film is very interesting and exciting, but it is necessary to understand . It is fantastical, but as for me it was interesting to see what we can do when we sleep.

Gilgamesh Synopsis

The Epic of Gilgamesh is an ancient poem/literature from Mesopotamia (present day Iraq). The Epic of Gilgamesh is amongst the earliest work of literature known to man. This Literature was originally inscribed on 12 clay tablets in cuneiform script. This literature explores the adventures of Gilgamesh, the historical part-god and part-human King of Uruk (one of the many cities in ancient Mesopotamia). This literature also explores the boundaries of love, friendship, death, immortality, and life as we might relate to it today.Gilgamesh was two-thirds god and one-third human/mortal. He was portrayed in the literature a human king of his people of Uruk and also a supernatural god. Gilgamesh was the strongest of all men, the bravest of the bravest, and a magnificent builder. One of Gilgamesh’s greatest accomplishments was that he was able to build temple towers (ziggurats) and walls that protected his Uruk people from invasions. The Epic of Gilgamesh described a catastrophic flood similar to that experienced by Noah in the Christian bible.This Noah like character was known as Utnapishtim in this literature. He was a king and priest who was granted immortality from the gods after his great boat carried him, his wife, and every living creature to safety after the flood. Utnapishtim was the keeper of the secrets of immortality. Despite some of Gilgamesh’s great accomplishments he was very arrogant as a king and as a mortal who had some godlike features. The people of Uruk were fearful of Gilgamesh, and they prayed to their gods to liberate them from Gilgamesh’s arrogance.Relief came in the form of Enkidu, the beastly man who sought to be Gilgamesh’s rival but instead became his good companion, after being seduced by Shamhat (the temple prostitute). Gilgamesh lived a life of supremacy and adventures. Gilgamesh and his companion Enkidu achieved numerous victories over their adversaries, one of which was the demon Humbada. The gods had later pu nished Gilgamesh and Enkidu for their forms of tyranny by giving Enkidu a slow and painful death. After the death of companion and friend Enkidu, a grief-stricken Gilgamesh became fearful of his own mortality and went in pursuit of Utnapishtim’s secrets of immortality.Gilgamesh traveled the ends of the earth searching for Utnapishtim, the one man whom the Gods saved from the flood, and who was supposed to be able to give Gilgamesh immortality. Gilgamesh’s pursuit for immortality was futile, despite that fact that he was giving an alternative for attaining immortality in the form of a plant which was located at the bottom of the ocean. Gilgamesh went back to Uruk not only tired and weary but, as a changed man with a more approving attitude about life. Gilgamesh seemingly became more appreciative of mortality and optimistic about still achieving greatness and a legacy as a mortal versus an immortal.

My dad told me ofa time when he was in school he was watching this bully pick on a kid and the kid got mad and punched the bully in the nose and broke it. The bully did not mess with the kid after that and the bully got suspended and the kid basically became a hero. Another example is that at my old school an ex-friend of mine was mad at me for something, so he decided to come up to me and punch me in the back of the head, in n instant from Just retaliating from a mysterious hit to the head I swing and hit him in the face and give him a black eye. Well as it turned out he got suspended for a week and I was not punished. After that me and the ex friend got along a little better but not close friends again. Also, me and a teammate got into a fght after school one day well, we did not get into trouble but it did help with the problem we had. Since that fght we have gotten along a lot more and we did not fght again. So in conclusion the self-defense rule can help the students a lot more than the no tolerance rule would. It will help the students learn to solve their own problems and take care of themselves without adult intervention. It also helps the students prepare for the world when they leave, if a student goes into the world believing that they should never ever get into a fght then when they get attacked in an alley or get into a situation that would require self-defense, they might Just get into a fetal position and hope they dont get killed. After finding the egg and realizing it is a dragon Eragon knows he has to do what he was destined to do: train Saphira and overthrow the Empire. â€Å"He raced home, trying to escape the dragon my dragon† (pg. 6) This mindset of Eragon shows that as much as he wants to escape the dragon, he can’t because he has made a special bond with the dragon and will inevitably raise her as his own, and because Eragon’s eye that catches the stone in the forest leads him to become the next dragon rider and to overthrow the evil reign of King Galbatorix. Also by coincidence, there is a story teller (Brom) who lives in Eragon’s village who has a great deal of knowledge about dragons and magic, and decides to aid Eragon in his journey. After Eragon is aware that Brom is willing to help him, this pushes Eragon to make the decision and to take the responsibility as the next dragon rider. Eragon learns a great deal from Brom, who becomes one of his closest friends who also ends up being a dragon rider many years ago. Being the good friends they become Brom aids him and Eragon has the knowledge and strength to defeat Durza (Galbatorix’s Shade). When captured by the Ra’zac and almost being killed, another coincidence occurs when a mysterious figure scares away the Ra’zac saving Eragon’s, Brom’s and Saphira’s lives. This mysterious person, whose name is Murtagh, also joins Eragon in his journey and assists him in killing the Ra’zac. This coincidence results in Murtagh saving Eragon’s life and continuing their journey, as well finding a helper in Murtagh to support him in his journey. †Who are you? † â€Å"Murtagh† (pg. 268) Not only does Murtagh save their lives but he plays a big role in helping Eragon, but shows how without Murtagh he would not make it as far as he did. Knowing Brom dies shortly after) Making a decision can alter someone’s life forever, and there is no going back especially when the decisions affects other people’s lives as well, making the decisions irreversible. Eragon makes the decision to keep the egg and when it hatches and to raise Saphira as his own, this leads to the Ra’zac coming to his doorstep and killing his uncle. This is a significant event because Eragon’s uncle was practically his father and making the decision to keep the egg results in his uncle’s death, and without him he feels lost; however, the bond he creates with Saphira is so immense, that only death can break it. The Empire is alerted that Eragon has the egg, and the send the Ra’zac to retrieve the egg back for the King. Making the decision to keep the egg is what instigates his entire journey and creates that special bond with his dragon. Eragon makes the decision to pursue the killers to avenge his uncle’s death and to bring peace to Alagaesia. He changes his life by pursuing the Ra’zac wanting the satisfaction of doing to the Ra’zac what they did to his uncle and feeling obligated to his uncle for all that he has done in his life to apprehend the murderers â€Å"What do you want me to do ursue the strangers? † (pg. 92) He asks this of Saphira, who agrees with Eragon to pursue the strangers. With this one decision of following the killers, he changes his life dramatically and if he succeeds, he can change everybody’s life for the better. Eragon decides that he cannot continue his journey without more help, so he travels to the Beor Mountains to seek help from the Varden, a rebellious group also against the Empire. After Brom dies, Murtagh helps him; however, this is not enough after he knows he has too many enemies: Urgals, the Ra’zac and Durza the shade. It is a desperate path to take We are desperate† (pg. 320). This decision is a great benefit to Eragon because he gets all the help he needs, meets the person who has been in his dreams in Arya (an elf from the Varden who is trapped) and eventually kills Durza. When a person desires something in life, he/she will do whatever it takes to achieve it, sometimes the desire is so strong that is can change someone’s life. Eragon has a desire to avenge his Uncle Garrow’s death after the Ra’zac brutally murders him. This eventually changes his life, because of chasing the killers. And what would give him more satisfaction than hunting down the strangers? †(pg. 93) He asks Saphira how he can satisfy himself, then realizes hunting them down and killing them would be the only way to achieve total satisfaction for his burning desire to avenge his uncle as well as finally feeling the sense of accomplishment of the commitment he made. Eragon has a desire to become the very best he can at magic, and swordsmanship, this pushes him to become the best so he can fend off for himself and not rely on others to help him. It is time for you to use the blade We’ll cut each other to ribbons Not so. Again you forget magic† (pg. 159) This is when Eragon and Brom have their daily sparring, where Brom teaches Eragon how to fight with a sword and magic, his desire to become the best shows when he wants to learn something new every time they spar. After seeing Arya imprisoned in his dreams, he is determined and has a desire to rescue her. Arya, who ends up being the elf that sent the egg to Eragon in the first place. â€Å"I expect the queen’s hostility will abate. The fact you rescued Arya will greatly help our case with her† (pg. 410) The queen is somewhat against having a dragon rider joining the Varden, but because he had a desire to rescue her and risked his life saving Arya, the queen allows Eragon to join. Sometimes in life people have to make tough choices that will positively or negatively affect others around them. The choices we make can change our and other people’s lives forever, there are many things that may change how our life is played out, coincidences, decisions, and desires just being a few.

Wind Stability Engineering in High Rise Buildings In building construction, there is a reciprocal relationship between forces within and external to the structure that directly affect stability and longevity. Fundamentally, damped oscillations operate within a system where a resistance (oftentimes passive) is applied to the structure in direct conflict with the natural or imposed oscillation, thereby stopping the movement (Knight, 2007).   Forced oscillations also act upon a structure as harmonic resonance is neared. In such systems, there is a natural oscillating frequency (number of oscillations completed per second) which operates within the structure, and an external force termed the driving frequency which acts upon the system. Large differences between these two forces do not actively define the amplitude of the oscillations; however, when they are numerically equal to each other, harmonic resonance results, highlighting the maximum amplitude of the system (Knight, 2007). Damped systems utilise force to reduce the affect of oscillations on structural integrity, thereby preserving the lifecycle of the building. To design and appropriately calculate the functions of a damped harmonic oscillator, the following components are needed where is equal to a constant and is equal to the structural mass. This formula represents several functions of the structural stability including where in which a critically damped case arises and equilibrium is quickly established; where the system is over-damped and equilibrium is slowly reached; and where the system is under-damped and exhibiting transient behaviour (Elert, 2007). Perhaps the most famous example of harmonic resonance leading to structural deformation, the Tacoma Narrows Suspension Bridge in the United States has been oft studied by scientists and scholars to determine the forced collapse. The product of a galloping oscillation, this structure was subjected to high wind forces (35mph) which excited the bridge’s transverse vibration mode, resulting in three hours of motion with an amplitude of 1.5 feet (Irvine, 1999). A supplemental increase in wind to 42 miles per hour caused dampening cables to snap, resulting in an unbalanced load condition that increased the amplitude to 28 feet, and ultimately ended in collapse (Irvine, 1999). More modern examples of structures functioning under the support of dampers include Victory Monument on Poklyonnaya Hill in Russia which features three dynamic oscillation dampers, fifteen flexural oscillation dampers, and one torsional oscillation damper (â€Å"High-Rise Constructions,† 2008). Represent ative of a system utilising both active and passive damping forces to reduce structural vibrations, this structure rises 141.8 m and retains a skeletal framework of steel latticework, requiring the enhanced oscillation damping. In high rise building construction, oscillations due to wind forces acting in both linear and non-linear capacities directly contribute to structural instability. Etkin and Hansen (1984) note that within such systems, artificial dampers limit the motions and resulting stresses and through a determination of the amplitude of response consistent with wind related variables, predictive measures can identify the maximum reaction. Similar forces directly contribute to structural destabilisation, undermining integrity through resonance and incumbent force variables. In 1994 a crane in Germany demonstrated the influence of galloping induced oscillations as it was destroyed by fatigue cracks in the tension bars during the bending mode at resting state (Hortmanns and Ruscheweyh, 1997). Resulting from wind based forces in a state of quasi-stationary vibrations, such structural conflicts oftentimes occur in large scale construction applications and cylindrical structures (Hortmanns and Ruschewe yh, 1997). Theoretical investigation of multiple vector damped linear systems has determined that resonant modes are free of coupling due to the damping forces, causing the system to behave as a sum of independent one-dimensional subsystems (Mathieu, 1965). The initial formulaic calculation for such a system is as follows: When coupled with Raleigh’s assumption of proportion between stiffness and damping, this formula enables multiple variable calculations within a linear system that are mathematically independent of system counterparts (Mathieu, 1965). Effective in determining the relationship between frequency and harmonic balance at differing segments as well as varied temporal intervals, this equation is one more step towards comprehensive structural analysis. Considering that high rise structures demonstrate an incidence of wind-generated harmonic flux as well as torsional sinusoidal wave vibrations based on innate building oscillations, calculating amplitude at varied temporal positions offers long term predictions of stability and maximum collapse potential (Katagiri et al., 2001). The preceding sections demonstrate the innate relationship between harmonic resonance and the forces which act both internally and externally to a structure. Ultimately, resistance is derived through damped systems or a forced resonance, thereby counteracting the effects of wind, torsional movement, and ground shifting. More modern investigation into differentials between linear and non-linear systems as exemplified by exploiting Raleigh’s formulae in Mathieu demonstrate that variables within the resonant system oftentimes operate individually, thereby prescribing unique forces without concurrent incidence within counterparts. Bipolar disease is defined as: "This disease causes symptoms like mood swings with periods of both depression and mania. They have consequent changes in thinking and behavior. Bipolar means the sharing of two poles, or high and low, having to do with mood."(2)   Ã‚  Ã‚   " Hamlet's behavior throughout the play was extremely physical, excessive talkativeness, destructiveness and sometimes grandiosity. These mood characteristics are the effects of bipolar disease." (1) Hamlet is extremely physical in his dealings with Ophelia and Gertrude. His excessive talkativeness is most evident in his soliloquies and his dialogue with his mother. His destructiveness is obvious in his conversation with the ghost; his grandiosity in his sarcasm towards Polonius. Incredibly, Bipolar disease describes Hamlet's behavior very accurately.    When Hamlet’s father was murdered by Claudius, difficulties arose between Hamlet and Gertrude to cope with one another. Hamlet got angry with his mother for remarrying Claudius, his father’s murderer, that he decides to be more rough towards her, simply to gain control over her.   Ã‚   When Hamlet grew up with his father and his mother, they grew up with a disorder known as Bipolar disease. "This is a disease where you think delusional, since it was inherited, passed on from parent to child, Gertrude’s marriage and Hamlet’s reaction to it, could have been the effects of this symptom. Hamlet’s father was "an enabler" who had made it possible for them to function, but now that his father is dead, they found it tough to cope with each other, as the family they once had."(1)   Ã‚  Ã‚   Hamlet became angry for a reason, which was to try to get attention from his mother. This attention came in a sexual form, as shown when he kissed her and when he groped her. With this new bond, he tried to gain further control over his mother, to try and abolish the marriage between her and Claudius. Two quotes to support this are: Queen: "Nay then, I’ll set those to you that can speak." (III;iv) Hamlet: "Come, come, and sit you down; you shall not budge." (III;iv)   Ã‚  Ã‚   This occurs when he tells Gertrude she can’t move, therefore he shows to the viewers he has power over what she says and does. If he cared, he would let her function as she wanted to, and he would support her decision.

College or Univeristy Graduation Speech -- Graduation Speech, Commence

I’ve spent weeks trying to think of what it is I’d like to share with you on this special morning†¦ what words of wisdom I could possibly impart, what bits of knowledge I have obtained during these past five years that I could share. And after careful deliberation and consideration, I came to the conclusion that I have absolutely nothing to say. I’ve asked several people, "So, like, if you were listening to a speech, and, like, you wanted to enjoy it†¦ what would you want to hear?" And these several people all had the same reply, "Don’t be boring." So, that was a really big help. I refuse to start out with some sort of typical, "My fellow graduates†¦" introduction, and I’ll be gosh-darned if I start with a quote, like, "As Shakespeare once said†¦".. Basically, I realized that I’m walking away with a degree in Physics, and I cannot compose a simple graduation speech. Someone needs to explain to me how I can complete five years of college and leave here incapable of delivering a simple speech. I’m a little bitter. The problem is that I’m not sure whether the lessons I’ve learned are the types of things you talk about in a speech like this. Most of the graduation speeches I’ve heard seem to be along the lines of, "You are the future! You are the promise of tomorrow! Dream and you will succeed!" And that’s really great; those are nice things to hear. But I can honestly say that I have never reached a difficult moment in my life and then thought, "I didn’t know what to do, but then I remembered something my graduation speaker once said, and everything fell into place!" So, I’m not here to give advice, and I’m not here to impart words of wisdom, and I’m not here to inspire you to succeed. I would just like to wish you all the good and... ...ied to. Waking up five minutes before the alarm is supposed to go off. Missing your flight. Spilling your drink. Breaking a dish. Arguments over stupid things. Sunburns. Saying goodbye†¦ You may never be a CEO. You may never win an Oscar. You may never sing at the Met. You may never get married and have a family. But this is your story. That’s it. One shot. Feel it all. I don’t have the faintest idea what’s going to happen, and I think it’s great. Social Norms of State University Students Concerning Alcohol Use Alcohol use on college campuses has been a hot issue for students and faculty for many years. Yet, there is still no concrete evidence as to the effects of alcohol use on college students. The perceived situation is college students binge drink and their grades are adversely affected. Is this a social norm? The question is whether these perceived social norms towards alcohol use on college campuses are in fact the social norms of college students. The purpose of this study is to gain an understanding of the true social norms of State University student’s attitude and practice in regards to alcohol. The sample is significant to Bradley University, using only Bradley students. The study will benefit the Wellness Center in its current social norms campaign. The study’s goal is to better understand the attitudes and practices of Bradley students toward alcohol consumption. METHOD SECTION Before we decided what methods we were going to use to collect the information, a mock focus group was held. The mock focus group consisted of Bradley students ranging in ages from 18 through 22, and was a mixture of on-campus and off-campus students. The purpose of the mock-focus group was to decide what types of questions should be chosen to get the most useful information for the social norms campaign. The mock focus group led the study in the direction of asking students not only their personal alcohol uses, but also how other students’ drinking affects their lives. We were looking for quantitative data; therefore, the idea of a focus group was immediately rejected. Constraints of money, time and manpower prevented the use of any probability sample. Many sampling... .... The questions were not in depth, but did give direction for further study. A larger and more age-diversified study may help correct possible errors in this survey. The fact that ninety percent of students in the study resided on-campus may also have effected the campaign and should be checked for errors. The study was limited to answers provided, in majority, by those students who can not legally drink, which is a factor that could limit the study. The two areas presented above as areas of significance could benefit from further study, as more in-depth research could provide more accurate results. The results of the study indicate the perceived social norms of college students may not be true. College students are perceived as heavy drinkers, yet the results seem to indicate a majority of students consume only a few drinks per week. More in depth study is suggested.

Americans with Disability Act of 1990

The American population of disabled workers previously had no protection of their employment or mandates pressed upon their employer to provide necessary work accommodations, to protect their livelihood, until the passage of the Americans with Disabilities Act of 1990 (ADA). The Americans with Disabilities Act is a civil rights law that prohibits employers to discriminate based on an employee’s disability. This paper will demonstrate the components of the Americans with Disabilities Act of 1990, as well as provide relevant United States Supreme Court cases set out between employee and employer where the law was challenged or upheld. The Americans with Disabilities Act of 1990 is an Act set out to â€Å"establish a clear and comprehensive prohibition of discrimination on the basis of disability† (Americans with disabilities, 1990). The Act was introduced to the Senate by Senator Tom Harkins on May 9, 1989. The Act was passed by the Senate on September 7, 1989 by a vote of 76-8 and passed by a unanimous voice vote before the House of Representatives on May 22, 1990. The Act was enacted by the 101st United States Congress and signed into law by President George W. Bush on July 26, 1990 (Americans with disabilities, 1990). ADA Issue: Definition of Disability Under the American with Disabilities Act the term â€Å"disability† refers to a â€Å"physical or mental impairment that substantially limits a major life activity† (Americans with disabilities, 1990). The case between Toyota Motor Manufacturing, Kentucky, Inc. v. Williams was presented to the United States Supreme Court on November 7, 2001. The case primarily questioned how you determine whether an individual is substantially limited in the major life activity of performing manual tasks. Under the American’s with Disabilities Act of 1990, 104 Stat. 328, 42 U. S. C. 12101 et seq. (1994 ed. And Supp. V), a physical impairment that â€Å"substantially limits one or more†¦major life activities† is a â€Å"disability. † 42 U. S. C. 12102 (2) (A) (1994 ed. ). Respondent, Ella Williams, claimed to be disabled due to carpal tunnel syndrome and sued, petitioner, her former employer, Toyota Motor Manufacturing, Kentucky, Inc. , for failing to provide accommodations as required under the American with Disabilities Act. Toyota Motor Manufacturing, Kentucky, Inc. v. Williams, (00-1089) 534 U. S. 184 (2002). ] Ella Williams began employment at Toyota Motor Manufacturing in Georgetown, Kentucky, in August of 1990. She was placed on the engine fabrication assembly line, where her duties included work with pneumatic tools. Utilizing these tools over time caused pain in respondent’s hands, wrists and arms. She was treated by her physician and found to have carpal tunnel syndrome and bilateral tendonitis. Her physician released her to return to work with restrictions that included no lifting more than 20 pounds, she could not lift or carry objects weighing more than 10 pounds, must not engage in constant repetitive motion of the wrists and elbows and no overhead work or performing tasks utilizing vibratory or pneumatic tools. Toyota Motor Manufacturing responded to Williams’ restrictions, for the next two years, by modifying her job responsibilities within the medical restriction guidelines. Despite this revision, Williams missed work for medical leave and she filed a claim under the Kentucky Worker’s Compensation Act. Ky. Rev. Stat. Ann 342. 0011 et seq (1997 and Supp. 2000). The parties settled this claim and Williams returned to work. Williams was still not satisfied with petitioner’s efforts to accommodate her work restrictions and she filed suit against Toyota in the United States District Court for the Eastern District of Kentucky alleging that petitioner ha d violated the ADA by refusing to accommodate her disability. The suit was settled, and as part of the settlement, respondent was able to return to work in December of 1993. Upon Williams return, Toyota accommodated respondent by placing her in the Quality Control Inspection Operations Department. The team’s tasks included (1) â€Å"assembly paint†, (2) â€Å"Paint second inspection†; (3) â€Å"shell body audit†; and (4) â€Å"ED surface repair†. Williams was placed on a team that performed only two of these tasks and rotated between the two roles. In assembly paint, Williams would visually inspect painted cars moving slowly down the conveyor and then rotated every other week to the second piece of her role, which was to examine the cars by lifting the hoods and opening the doors. She was able to perform these duties as described. There was a change in workflows in the Department of Quality Control where all employees must rotate between the four tasks of the quality operations. Williams attempted to perform all four duties as required, but began having increased pain, sought medical treatment was diagnosed with myotendonitis bilateral periscapular, inflammation of the muscles and tendons of the shoulder blades and forearms and thoracic outlet syndrome. Williams requested to return to only performing the two components of her position. The parties disagree on what happens next, Williams’ states that Toyota refused her request. Toyota states that the employee began missing work excessively and they were forced to terminate her position for poor attendance. Williams again sued under the Americans with Disability Act of 1990. During the court proceedings and on deposition Williams stated that she was â€Å"disabled† as she was no longer able to perform activities of daily living that included (1) manual tasks; (2) housework; (3) gardening; (4) playing with her children; (5) lifting; and (6) working, all of which, she argued, constituted major life activities under the Act. [Toyota Motor Manufacturing, Kentucky, Inc. v. Williams, (00-1089) 534 U. S. 184 (2002). Under the ADA the claimant must show that the limitation on the major life activity is substantial 42 U. S. C. 12102 (2)(A). â€Å"Substantially limits† was defined as unable to perform a major life activity that the average person in the general population can perform†. In determining whether an individual is substantially limited i n a major life activity, the regulations instruct that the following factors should be considered: â€Å"the nature and severity of the impairment; the duration or expected duration of the impairment; and the permanent or long term impact, or the expected permanent or long-term impact of or resulting from impairment. 1630. 2(j)(2)(i)-(iii) (Americans with disabilities, 1990). The court concluded on January 8, 2002 that the respondent’s impairments substantially limited her in the â€Å"major life activities† of performing manual tasks and was found to be â€Å"disabled† as defined under the Americans with Disabilities Act, and therefore granted judgment to respondent on the basis that Toyota violated the Act by not accommodating her request as a disabled individual. [Toyota Motor Manufacturing, Kentucky, Inc. v. Williams, (00-1089) 534 U. S. 184 (2002). ADA Issue: Definition of Disability and Direct Threat The Americans with Disabilities Act of 1990, under Title II, prohibits disability discrimination by all public entities. Public entities must comply with the ADA regulations by the U. S. Department of Justice and includes granting access to all programs and services without disability discrimination. Under the ADA regulations there is also a â€Å"direct threat† provision which protects facilities where an individual may pose a direct threat to the health or safety of others (Americans with disabilities, 1990). The U. S. Supreme Court Case No. 97-156, Randon Bragdon, Petitioner v. Sidney Abbott, Respondent, poses the question whether asymptomatic HIV infection is a disability under the ADA, and when determining whether an individual with HIV poses a direct threat to a health care provider, should the courts defer to the providers professional judgment [Bragdon v. Abbott (97-156) 107 F. 3d 934, (1998). ] Abbott is infected with HIV, but it had not manifested into the serious stages at the time of the incident. Abbott presented to her dental office and disclosed her HIV infection. Rangdon Bragdon, her dentist, refused to treat her in his office setting and sited his policy on filling cavities on HIV patients. He was willing to treat her in the hospital for no extra charge, but she would be responsible for the hospital bill. She declined and filed suit under the American with Disabilities Act of 1990 (ADA), which prohibits discrimination against any individual†¦ â€Å"on the basis of disability in the †¦enjoyment of the†¦services†¦of any place of public accommodation by any person who†¦operates [such] a place,† 42 U. S. C. 2182 (a), but qualifies the prohibition by providing: â€Å"Nothing [herein] shall require an entity to permit an individual to participate in or benefit from the†¦ accommodations of such entity where such individual poses a direct threat to the health or safety of others,† 12182(b)(3) (Americans with Disabilities, 1990). The court ruled in favor of the respondent, Sidney Abbott, on June 25, 1998. E ven though the respondent’s HIV had not progressed to the point of being symptomatic, HIV is a â€Å"disability† under 12102 (2)(A), that is, â€Å"a physical†¦impairment that substantially limits one or more of the major life activities. The life activity upon which respondent relies, her ability to reproduce and to bear children, constitutes a â€Å"major life activity† under the ADA. Self Evaluation Essay I was quite confident about my writing style and had the impression that I am competent enough. But when more than one of my projects got remarks like ‘improve your writing skill’ and ‘work hard on your writing style’, I was shocked and was unable to look for my faults. I had to discuss with one of my teachers who explained that I was using parallelism in my writing style, which was quite boring and repetitive. Then I noticed that I was using some of the words quite a lot of time and they were even repeated quite a lot of times in one single sentence. When I read my story I found that lots of characters were created which either confused the reader or left them bewildered. I had to really work hard so that I make my essays or stories interesting for the reader. While analyzing my early essays I found that most of the time I got diverted from the main stream of discussion and wasted my pages on not so important issues. I now understand it was because I need to draw on outline of my essay before finally writing it. I should deal the objectives and organize them according to the preferences required hile writing it. Repetitive use of words or phrases spoils the charm of writing and fails to make story interesting. Even if the plot is good and organized, it needs to be appealing so that the reader finds it out of the ordinary. I had the idea that repetitive use of words and phrases add weight to your work but it is not in essays or stories. It gives the impression that the writer is using same words just because he is lacking original ideas for the story. This gives a bad impression and cuts your marks eventually. I was always against plagiarism and had the idea that it is just copying word by word of some other writer’s work. But even if you use some facts by changing few words with their synonyms is also categorized under plagiarism. It was quite difficult to understand this issue but I will have to work on it so that my essays are not remarked as ‘plagiarized’. I use sources from Internet or some times related books to research on any matter. I have written different essays on numerous subjects and all I was able to find on Internet. I researched and then collected the matter, read and organized them and wrote iving my opinion on the issue. I have been getting experienced in different types of essays dealing personal as well as public issues. I worked on various writing styles like MLA format, APA format, Chicago style and many more. Initially these were quite new for me but as I worked cautiously and followed the instructions it has become quite easy for me now. To mesmerize the reader it is important to maintain the charm of your topic and suspense of the story till its end. For a good writer it is important that the reader has lots of quarries hile reading the story so that he is not in a position to leave reading it until he ends it. It is an ongoing process and one needs to improve a lot to become a good writer. Lots of practice and a good guidance will help you improve your writing skills. When I was first pointed out with my mistakes I thought I would never be able to improve these things as they come in flow of my natural way of writing. But I was wrong because during the course I was not only able to get rid of my drawbacks but also improved and made my writing style interesting from the point of view of readers. Now this is the most important thing for a writer and he/she can get rewards only when his work gets appreciated by his/her readers. There are lots of things to be taken in to consideration when you research on writing skills and you will feel that you need to learn quite a lot of stuff on the art of writing. It is actually a vast area and there are things that are required to learn and some areas get developed with your experience too. I found that the areas, which used to involve me for hours while writing an essay is now engaging me for remarkably less time. These all happened because of correct learning procedure and practice also. As far as parallelism is considered it is not completely useless but you will find it very useful while writing employment documents. Here you need to put stress on some person or his qualities and it is effective only when you repeat words and phrases. So avoiding parallel style of writing entirely is not right. There are times when you need to echo some facts and there you will need this style along with balance and rhythm so that you are able to convey your actual meaning and intention.
